Hume PLLC, “Hume Law”.  This website is offered for your use, contingent upon your acceptance without modification of all of the terms and conditions set forth below (collectively the “Terms”). By accessing or using this website in any manner, you agree to be bound by these Terms.  Please read these Terms carefully.  If you do not accept all of these Terms, please do not use this website.  You will need to return to this page periodically to review the most current version of the Terms.  We reserve the right at any time to change or otherwise modify these Terms without prior notice and your continued access or use of this website signifies your acceptance of the updated or modified Terms.

A. Purpose of Website

Our website is designed to provide visitors to the site with information concerning the legal services we offer, our attorneys and their experience, and other information concerning our firm. Please note that use of the website is not intended to constitute, and does not constitute, solicitation for the formation of an attorney-client relationship.  No attorney-client relationship is created by your use of the website.  In addition, neither access to or receipt of information from this website, nor any email or other electronic communication sent through this website, will create an attorney-client relationship.  Any such email or electronic communication will not be treated as confidential.  No user of this website should act or refrain from acting on the basis of information included on this website without seeking advice of legal counsel in the applicable jurisdiction.  Hume Law expressly disclaims any liability relating to actions taken or not taken based on any contents of this website.

B. Privacy Policy

Hume Law’s Privacy Policy (“Privacy Policy”), which is incorporated herein by reference, also governs use of the website. The Privacy Policy identifies how we collect and use your information and content.  Because your privacy is important to us, we encourage you to read the Privacy Policy carefully and use it to make informed decisions. Please note we reserve the right to amend these Terms or the Privacy Policy as the need arises. Accessing the website, after the effective date of any changes to these Terms or the Privacy Policy constitutes acceptance of these terms and the Privacy Policy as modified.

This website is operated from the United States of America and is not intended to be subject to non-U.S. jurisdiction or laws.  If you access the website, you do so at your own risk, and you are responsible for complying with all local laws where you reside or where you access the website.  We do not represent the content or materials present in the website are appropriate for use in other locations.  We may limit the availability of the website in whole or in part to any person, location or jurisdiction we choose at any time.

Submission of information through this website is governed by the Privacy Policy.  You agree that all information that you provide to us is true, accurate and complete.  If you choose to make any personal information available to us, you do so at your own risk.

F. Use of the Website; Rules of Conduct

  • Use any robot, spider, site search/retrieval application or other manual or automatic device to retrieve, index, “scrape,” “data mine” or in any way gather content from the website or reproduce or circumvent the navigational structure or presentation of the website.  Notwithstanding the foregoing, Hume Law grants the operators of public online search engines limited permission to use search retrieval applications to reproduce materials from the website for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of such materials solely in connection with each operator’s public online search service. We reserve the right to revoke these exceptions either generally or in specific instances.

Without limiting any other remedies, Hume Law may limit, suspend, terminate or modify access to the website or portions thereof, with or without notice to you, if Hume Law suspects that you are failing to comply with any of these terms or for any actual or suspected illegal or improper use of the website or the services.

G. Ownership

The website, including without limitation any computer code, software, themes, objects, photographs, stories, dialogue, catch phrases, concepts, artwork, animations, sounds, audio-visual effects, methods of operation, moral rights, documentation, profile information and recordings, are works owned or licensed by Hume Law.  Hume Law reserves all rights, including without limitation all intellectual property rights or other proprietary rights, in connection with the website and its content.

Your information, and the contents of all of your online communications (including without limitation communications, IP addresses and your personal information) may be accessed and monitored as necessary and may be disclosed: (a) when we have a good faith belief that we are required to disclose the information in response to legal process (for example, a court order, search warrant or subpoena); (b) to satisfy any applicable laws or regulations; (c) if we believe that the website is being used in the commission of a crime, including to report such criminal activity or to exchange information with other companies and organizations for the purposes of fraud protection; (d) when we have a good faith belief that there is an emergency that poses a threat to the health and/or safety of you, another person or the public generally; and (e) in order to protect the rights or property of Hume Law, including to enforce these Terms. By entering into these Terms, you hereby provide your irrevocable consent to such monitoring, access and disclosure.

H. Links to Other Websites

You should be aware that when you are on the website you could be directed to other websites beyond our control.  For example, if you “click” on a link, the “click” may take you off our website onto a different website.  These other websites may send their own cookies to you, independently collect data or solicit personal information and may or may not have their own published privacy policies.

WITHOUT LIMITING THE FOREGOING, NEITHER HUME LAW NOR ITS EMPLOYEES, AGENTS, ATTORNEYS, THIRD-PARTY CONTENT PROVIDERS, LICENSEES OR LICENSORS WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

K. Indemnification

Except to the extent prohibited under applicable law, you indemnify and hold Hume Law harmless from any claims, losses, damages and liabilities, including legal fees and expenses, arising out of your use or misuse of the website or activities connected with the website or any violation by you of these Terms.  Hume Law reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify Hume Law, and you agree to cooperate with Hume Law’s defense of these claims. Hume Law will use reasonable efforts to notify you of any such claim, action, or proceeding upon becoming aware of it. The provisions of this paragraph will survive any termination of the website.

L. Law and Forum for Legal Disputes

These Terms and any dispute arising out of or related to them or the Service shall be governed in all respects by the laws of the Commonwealth of Kentucky as they apply to agreements entered into and to be performed entirely within Kentucky between Kentucky residents, without regard to conflict of law provisions. You agree that any claim or dispute you may have against Hume Law must be resolved exclusively by a state or federal court located in Kentucky.  You agree to submit to the personal jurisdiction of the courts located within Kentucky for the purpose of litigating all such claims or disputes.

M. Severability

You agree that if any portion of these Terms or of the Privacy Policy is found illegal or unenforceable, in whole or in part by any court of competent jurisdiction, such provision shall, as to such jurisdiction, be ineffective solely to the extent of such determination of invalidity or unenforceability without affecting the validity or enforceability thereof in any other manner or jurisdiction and without affecting the remaining provisions of these Terms, which shall continue to be in full force and effect.

N. General Provisions

            1.         Assignment.  Hume Law may assign or delegate these Terms and/or the Hume Law Privacy Policy, in whole or in part, to any person or entity at any time with or without your consent. You may not assign or delegate any rights or obligations under the Terms or Privacy Policy without our prior written consent, and any unauthorized assignment and delegation by you is void and ineffective.

            2.         Equitable Remedies.  You acknowledge that the rights granted and obligations made under these Terms to Hume Law are of a unique and irreplaceable nature, the loss of which shall irreparably harm Hume Law and which cannot be replaced by monetary damages alone. Accordingly, Hume Law shall be entitled to injunctive or other equitable relief (without the obligations of posting any bond or surety or proof of damages) in the event of any breach or anticipatory breach by you.

            3.         Notices.  We may notify you via postings on this website, or through e-mail or any other communications means to contact information you provide to us.  If you are a user in the United States, all notices given by you or required from you under these Terms or the Privacy Policy shall be in writing and addressed as provided in the content update.  You consent to receive communications from us electronically.  You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy our legal requirements that such communications be in writing.  Any notices that you provide without compliance with this section on Notices shall have no legal effect.

            4.         No Waiver.  The failure of Hume Law to require or enforce strict performance by you of any provision of these Terms or the Privacy Policy or failure to exercise any right under them shall not be construed as a waiver or relinquishment of our right to assert or rely upon any such provision or right in that or any other instance.

            5.         Entire Agreement.  These Terms, any supplemental policies and any documents expressly incorporated by reference herein (including our Privacy Policy), contain the entire understanding of you and Hume Law, and supersede all prior understandings of the parties hereto relating to the subject matter hereof, whether electronic, oral or written, or whether established by custom, practice, policy or precedent, between you and us with respect to the website, the information on the website and their use.
